Assumption of Risk
I/We acknowledge, understand, and agree that cheerleading, dance, and gymnastics is a sport in which the risk of injury is high; that any one of the routines involving your child's participation in these activities in general could lead to serious injury, including partial or total paralysis, even death. Despite this understanding of the possibility of serious catastrophic injury or death and the risk involved, we still consent to the participation in this activity by our child and assume the risk of such illness or injury by participating. We understand that our child is required to be in good physical shape and condition and that the activities which she/he will be asked and expected to participate in, are strenuous and require physical and athletic agility. These activities include, but are not necessarily limited to, a variety of gymnastic routines, exercises, a variety of mounts and stunts requiring the coordination of more than one participant in team and individual classes/privates.

Release of Liability
I/We the undergoing parent(s)/legal guardian(s), do hereby grant permission for our child to participate in clinic(s), tryouts, any/all subsequent practices, camps, exhibitions, private lessons, cheer classes, and private use of the FCA Cheer facility, competitions and/or events (all program related activities) with FCA Cheer. I/We agree to and by the signing of this agreement, release FCA Cheer, coaches, volunteers, and any other location for practices from any claim of negligence by ourselves, our son/daughter, or relatives from any claims for loss of or damage of his/her property which may arise out of his/her participation in the FCA Cheer program.

Medical Emergencies
I/We hereby authorize the coaches or other supervising adult to obtain the necessary medical treatment and/or authorize medical transportation to the nearest medical center in the event that my child sustains an injury and/or illness during participation in these sports, and I hereby release FCA Cheer and its representatives from any claims for personal illness or injury that my child may sustain during participation in these activities. I/We accept full responsibility for any/all medical bills including transportation incurred during emergency or urgent care medical treatment sought on my child/legal ward's behalf and understand that the only insurance that covers said child is the cited participant's health insurance(s). I/We represent to you that, to the best of our knowledge and belief, our child has no physical, medical, or mental disability or other limitation that would restrict her/his ability to fully participate in this activity as described to us. The undersigned further certifies that said child is not allergic to any medication, drugs or food except as listed above.

Appearance Agreement
FCA Cheer may produce promotional materials about its programs. I/We understand that as a participant, your child may be included in videotapes and/or photographs taken during practice and/or events. I hereby grant FCA Cheer, its employees, directors, successors, assignees, licensees, volunteers, and/or sponsors, name face, likeness, voice, and appearance as a part of its program, and in advertising and promoting its programs, without reservation or limitation. All members of competitive teams are required to travel. I/We understand that our child will be required to travel to locations for the purpose of participating in FCA Cheer. I/We, hereby authorize FCA Cheer, it's agents, assigns, employees, and volunteer assistants to meet, transport, arrange for travel and transportation for my (our) child to any activity, trip, function, or the like sponsored by or participated in by FCA Cheer during the current season. This travel includes but is not limited to Air, Rail, Bus, Automobile, Boat or other public/private conveyance. It also applies to the securing of lodging, and food for the duration of said season. I agree that this "Consent to Travel" Form will be filed and will be in effect until written notification to revoke said consent has been received.

Financial Agreement
I authorize FCA Cheer to automatically charge my account on file for tuition, dues or fees owed or past due. It is my responsibiliy to make sure the account on file is up to date. With the exception of our private lessons and private gym rentals, tuition is due on the 25th of each month for the following month. There are no prorations or refunds. If accounts are paid after the 5th of the month, there will be a $10.00 late fee applied to the account balance. There is a $20.00 fee for declined credit/debit cards, and a $25.00 fee for ACH payments that do not go through. I/We accept FULL financial obligation for FCA Competitive Cheer team related expenses upon agreement and acceptance into the program. I/We understand that all fees must be paid to participate.

Resignation
If your child is enrolled on one of our competitive cheer teams and he/she chooses to leave the program, no fees will be refunded, this includes the current month's gym tuition, no exceptions. There will also be an EARLY TERMINATION CONTRACT FEE OF $500 that will be due on the day your child leaves the program. The season begins on June 1 and ends on May 31. Competition fees, choreography, uniform costs, etc. will not be refunded. Please understand, you and your cheerleader are entering a contract for a commitment for the entire cheer season. Cheerleading is a team sport, we need all members of the team all year to be successful.

COVID-19 Waiver
Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19 The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. FCA Cheer has put in place preventative measures to reduce the spread of COVID-19; however, FCA cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, your participation at FCA could increase your risk and your child(ren)'s risk of contracting COVID-19. By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending FCA and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at FCA may result from the actions, omissions, or negligence of myself and others, including, but not limited to, FCA employees, volunteers, and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)'s attendance at FCA or participation in FCA programming ("Claims"). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless FCA, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of FCA, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any FCA program.
